Coach-Net Mobile (“Application”) – End User License Agreement
This End User License Agreement (“Agreement”) outlines the terms related to your use of this Application provided to you by Coach-Net. For purpose of this agreement, you will be referred to as “You” or “End User” and Coach-Net shall be referred to as “Our” or “Coach-Net”.
This agreement does not change or amend in any way the Usage Rules set forth in the App Store terms and Conditions.
BY DOWNLOADING OR USING THE APPLICATION, YOU ACCEPT THESE TERMS. IF YOU DO NOT ACCEPT THEM, DO NOT DOWNLOAD OR USE THE APPLICATION.
IF YOU ACCESS ANY INTERNET BASED SERVICES VIA LINKS IN THE APPLICATION YOUR USE OF THOSE SERVICES WILL BE SUBJECT TO BOTH THIS AGREEMENT AND ANY SEPERATELY PROVIDED TERMS OF USE AND PRIVACY STATEMENT ON SUCH WEBSITE.
Coach-Net reserves the right, in sole discretion, to modify or change the terms of this Agreement at any time without prior notice to you.
LICENSE. Provided You comply with all terms and conditions of this Agreement, Coach-Net grants You revocable, limited, non-transferrable license to use the Application on any mobile device, that you own or control and as permitted by the Usage Rules set forth in the App store Terms and Conditions.
AGE REQUIREMENT. This Application is available to users of all ages. However, if you are under the age of 18, you should review this Agreement with your parent or guardian to make sure that you and your parent or guardian understand the terms and conditions in this Agreement.
COACH-NET MOBILE ROADSIDE ASSISTANCE IS INTENDED FOR THE USE OF CURRENT MEMBERS IN GOOD STANDING. If you are a current Member, and your account is in good standing, your coverage and benefit limits are subject to your current program.
VEHICLE ELIGIBILITY:
Any motorized or towable RV and all single rear-axle, two or more wheeled registered and licensed motor vehicles used for on-road transportation, including passenger vehicles, motorcycles and light trucks. Coverage also includes tow dollies, boat and utility trailers. Commercial vehicles, vehicles over 40 years old, dirt bikes, and ATVs are not eligible for coverage.
DISCLAIMER OF WARRANTY. The Application is licensed “as-is”. “with all faults,” and “as available”. You bear the risk of using it. Coach-Net, on behalf of itself, distributors of the Application, network operators over whose network the Application is distributed, and each of their respected affiliates and suppliers, gives no express or implied warranties, guarantees, or conditions under or in relation to the Application, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Coach-Net does not warrant that the functionality or operation of the Application will be corrected, or that the Application or the server(s) that make it available
are free from viruses or other harmful conditions or components.
LIMITATION OF LIABILITY. To the extent permitted by law, Coach-Net disclaims liability, whether based on contract, tort, negligence, strict liability or otherwise, for damages of any kind (including but not limited to, direct, indirect, incidental, consequential, special, punitive or exemplary damages) in any way arising from interruptions of service or delay in operation or transmission, and arising from third party access to personal information input in Application, even if Coach-Net has express knowledge of the possibility, and will in no way be held liable, for the security of the End User’s mobile device. You agree not to seek to recover damages, including consequential, lost profits, special, indirect or incidental damages from Coach-Net or any distributor of the Application.
OWNERSHIP. The Application including all text, graphics, user and visual interfaces, trademarks, logos, computer code, documentation and other content (collectively, the “Content”), is the exclusive property of Coach-Net and is protected by copyright, trademark and other intellectual property laws. Except as expressly provided in the Terms and Conditions, no part of the Application or Content may be copied, reproduced, sold, republished, reposted or otherwise distributed for public or commercial purposes.
LINKS TO OTHER WEBSITE. This Application may contain links to other web sites. Coach-Net provides links to other sites as a convenience to persons who use the Application. You agree that Coach-Net is not responsible for examining or evaluating the content or accuracy of any such third-party material or website. Coach-Net does not warrant or endorse and does not assume and will not have any liability or responsibility for any third-party materials or websites or for any other materials, products, or services of third-parties. If You choose to use the services provided by those sites, You may be asked by those sites to provide certain personally identifiable information (some of which may, on an individual or aggregate basis, be shared with Coach-Net). Please be aware that Coach-Net is not responsible for the privacy practices of those sites even though Coach-Net’s name or logo may appear on those sites. We encourage You to be aware when You leave Our Application, You should read the privacy policies of each web site You visit, as the privacy policies of those sites may differ from Ours.
COACH-NET PRODUCTS. Coach-Net may change the programs or products mentioned in this Application at any time without notice. Additionally, all products referred to in this Application are subject to availability and qualifications. Product terms, conditions, and exclusions not described in this Application may apply.
SUPPORT SERVICES. The Application is provided “as-is”. Neither distributors of the Application, Your phone manufacturer, or Your network operator are responsible for providing maintenance or support services for the Application.
JURISDICTION AND GOVERNING LAW. This Application is controlled, operated and intended for use only in the United States of America and Canada. We do not represent that materials in this Application are appropriate or made available for use outside of the United States of America and Canada. This Agreement shall be governed by and interpreted accordingly to the law of the state of Texas, excluding that body of law applicable to conflicts of law.
SEVERABILITY. If any provision of this Agreement is held invalid, void or unenforceable, then that provision will be considered severable from the remaining provisions, and the remaining provisions shall remain in full force and effect. Coach-Net’s failure to enforce any right or provision in this Agreement will not constitute a waiver of such provision, or any other provision in this Agreement.
PRIVACY POLICY. You represent that You shall comply with the terms and conditions of the Coach-Net Privacy Policy, which sets forth and describes the practices of Coach-Net with respect to the collection, use and disclosure of Information in connection with Your use of the Application. Coach-Net reserves the right to change the provisions of its Privacy Policy at any time and from time to time at its sole discretion. Coach-Net will post any changes to its Privacy Policy at the web address www.Coach-Net.com/privacypolicy. Your use of the Application following posting of such changes to the Privacy Policy will constitute Your acceptance of such changes.
MISCELLANEOUS. You agree to comply with all local, state, federal, and national laws, statues, ordinances, and regulations that apply to your use of this Application.
